RESOLUTION
OF THE VERKHOVNA RADA OF UKRAINE
“On fulfilling international obligations of Ukraine regarding releasing Tymoshenko Yu.V.”
Taking into account political motivation of the criminal prosecution and imprisonment of Tymoshenko Yulia Volodymyrivna established by the decision of the European Court of Human Rights of April 30, 2013 regarding “the case of Tymoshenko” (№ 49872/11),
Being governed by article 46 of the Convention for the Protection of Human Rights and Fundamental Freedoms, according to which, the Committee of Ministers of the Council of Europe is the only authority authorized to monitor fulfillment of decisions of the European Court of Human Rights, and to establish norms and ways of carrying out such decisions,
taking into account that the Decision of the Committee of Ministers of the Council of Europe, adopted at 1186 meeting on December 3-5, 2013, stipulates that Ukraine, by way of carrying out the decision of the European Court of Human Rights regarding “the case of Tymoshenko,” should urgently release Tymoshenko Yulia Volodymyrivna,
taking into account actual unjustified refusal of judicial and executive authorities of Ukraine to fulfill the decision of the European Court of Human Rights regarding “the case of Tymoshenko” established by the Decision of the Committee of Ministers of the Council of Europe adopted at 1186 meeting on December 3-5, 2013,
exercising parliamentary control over fulfilling international obligations of Ukraine, according to clause 33 of chapter one of article 85 of the Constitution of Ukraine,
expressing the sovereign will of the Ukrainian people, the Verkhovna Rada of Ukraine establishes:
1. That the State Penitentiary Service of Ukraine should immediately release Tymoshenko Yulia Volodymyrivna, born in 1960, convicted by the sentence of Pechersk District Court in Kyiv of October 11, 2011.
2. This Resolution comes into force since the day of its adoption.
